And in those states with these clauses (not all of them by the way) the teachers unions could defend against the lawsuits by providing money to teachers who face them. You're saying that the fear of being sued means teachers should fold. That means the bullies win. This is absurd. The unions could (and should) defend their teachers with funds, and hundreds of attorneys would take these cases pro bono. That is just no excuse, I'm sorry. It's not. Ultimately, these vigilante clauses are unenforceable under any theory of civil torts I can imagine holding up in court. You can’t legally sue someone for making your kid feel bad because you told the truth about history. If such a suit made it court it would be tossed. But if no teacher is willing to test it, then might as well turn the schools over to racists and let them win.
